TERMS OF SERVICE – SOMYA GARG ART (SGA)

By accessing somyagargart.com (the “Site”), you agree to be bound by these Terms & Conditions. Please read carefully.

All obligations under these Terms are managed by Somya Garg Art, GST-registered, operating under the brand name SGA.

1. General Conditions

  • SGA reserves the right to update prices, policies, and content at any time.

  • Under rare circumstances, orders may be cancelled or dispatch times extended, with prior communication.

  • Additional information may be requested to ensure successful delivery.

  • Service may be refused at SGA’s discretion.

2. Orders / Artwork Nature

  • All artworks offered are original works, created using materials selected by the artist as part of the creative process. Variations in surface, texture, tone, or material behavior are inherent to the nature of art and may evolve over time. These characteristics are considered integral to the artwork and do not constitute defects.

  • SGA is not liable for changes, wear, or damage that occur after an artwork has been delivered to and accepted by the collector, including those resulting from environmental conditions, handling, display, or passage of time.

  • Refunds or returns are not offered for subjective dissatisfaction, aesthetic preference, or natural variation in the artwork over time.

  • In the rare event that an artwork is lost or materially damaged during transit, a refund may be issued using the insurance payout, subject to verification and claim approval.

  • Image colors may vary slightly depending on display. Additional photos or videos can be provided upon request prior to purchase.

  • Somya Garg Art (SGA) does not guarantees longevity of the artworks.

3. Payment & Checkout

  • All purchases are processed via Direct Bank Transfer (RTGS) for domestic buyers or SWIFT Wire for international collectors.

  • High-value works require bank transfer due to international compliance and fraud protection.

  • PayPal is accepted only for small-value or convenience purchases, at SGA’s discretion.

  • SGA does not accept EMI or Pay Later payment options.

  • Payment is considered complete only when credited to SGA’s bank account; screenshots are not accepted.

4. Shipping & Delivery

  • Domestic: 7–14 business days

  • International: 14–21 business days

  • Pre-orders: shipped after the stated timeframe (allow at least 2 weeks)

Orders may arrive earlier than estimated. Shipping is complimentary worldwide. Each artwork is carefully packaged and dispatched via the most efficient route. A tracking number is provided upon shipment. SGA uses the maximum ETA to avoid inconvenience.

Collectors are responsible for customs duties, taxes, and import regulations in their country.

5. Insurance

  • All artworks are insured for their declared value during transit once shipment is booked and the insurance policy is active.

  • In case of loss or material damage during transit, the insurance payout will be used to refund the collector, subject to verification and policy conditions.

  • Collectors are not entitled to refunds for change of mind or subjective dissatisfaction.

6. Cancellation Policy

  • Cancellations within 2 days of placing an order: No cancellation fee.

  • Cancellations after 2 days of placing an order: 50% of total paid amount will be charged.

  • If delivery fails due to reasons outside SGA’s control, up to 100% of the total paid amount may be charged, depending on circumstances.

7. Liability

  • SGA is not liable for damage after the artwork has been delivered to the collector.

  • Collectors must read product descriptions carefully prior to purchase.

  • SGA is not responsible for damages caused by handling, display, environmental conditions, or natural ageing of the artwork.

8. Copyright & Intellectual Property

  • All artworks and site content are copyrighted by Somya Garg.

  • Images may not be reproduced, distributed, or used commercially without prior written permission.

  • Website design, text, graphics, and software are all copyright-protected.

9. Use of the Site

  • Collectors agree to use the Site in compliance with all applicable laws.

  • External links are provided for convenience; SGA is not responsible for their content.

  • The Site is provided “as is”; SGA disclaims all warranties, express or implied.

  • Access may be restricted or terminated at SGA’s discretion.

10. Personal Information Collection

  • Information collected includes details provided by collectors and data collected through the Site.

  • Data may be used to operate, manage, and promote future exhibitions, events, or special offers.

11. Your Rights

  • Collectors may access, correct, or request deletion of personal information.

  • Collectors may opt out of marketing communications at any time.

12. Errors & Omissions

  • SGA may correct errors, inaccuracies, or omissions in product information, pricing, offers, or availability at any time.

  • Orders may be cancelled or updated if information is inaccurate.

13. Governing Law

  • These Terms are governed by the laws of India, with exclusive jurisdiction of Indian courts.
